New issuances of U.S. collateralized loan obligations (“CLOs”) were approximately $70 billion in 2016, a year marked by major themes such as the U.S. risk retention rule becoming effective and continuing uncertainty about how the EU’s risk retention requirements would be modified as part of the “STS” process. In this chapter, published in the 2017 edition of The International Comparative Legal Guide to: Securitisation, partners Craig Stein and Paul N. Watterson, Jr. review the themes for CLOs in 2016 and discuss expectations for key developments in the U.S. CLO market in 2017. Partner Anna Maleva-Otto assisted in the preparation of this chapter.
